These Terms of Use ("Terms") are a legal agreement between you and Sergei Khrykov, Belgrade, Serbia ("the Developer"), governing your use of the Govori dictionary applications for iOS and Android ("the App"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
These Terms are concluded between you and the Developer only — not with Apple Inc. ("Apple") or Google LLC ("Google"). The Developer, not Apple or Google, is solely responsible for the App and its content. Where a clause below refers to the store you obtained the App from ("App Store" for iOS, "Google Play" for Android), only the provisions for that store apply to you.
The Developer grants you a personal, non-exclusive, non-transferable, revocable license to use the App for your own personal, non-commercial purposes on any device that you own or control.
For the iOS version, this license is limited to Apple-branded devices you own or control and is subject to the Usage Rules set out in the Apple Media Services Terms and Conditions (except that the App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing, where enabled). For the Android version, your use is also subject to the Google Play Terms of Service.
Core dictionary lookup is free. Additional features (such as inflection tables) are available free of charge during an introductory trial period starting at first launch, after which they require a purchase. The Developer may change the scope of free and paid features in future versions of the App.
Payments are processed by the store you downloaded the App from — Apple for iOS, Google Play for Android — and charged to your account with that store at confirmation of purchase. The Developer never receives or stores your payment details.
iOS (App Store): You can manage or cancel subscriptions at any time in your App Store account settings; cancellation takes effect at the end of the current billing period. Refunds are handled by Apple, not the Developer — request them at reportaproblem.apple.com.
Android (Google Play): You can manage or cancel subscriptions at any time under Subscriptions in the Google Play app or at play.google.com/store/account/subscriptions; cancellation takes effect at the end of the current billing period. Refunds are handled by Google in accordance with the Google Play refund policy, not the Developer — request them at support.google.com/googleplay.
The App's lexical content (headwords, definitions, inflections, examples) is adapted in part from Wiktionary, available under Creative Commons Attribution-ShareAlike licenses, and from other openly licensed sources, with substantial curation, correction, and additional material by the Developer.
The content is provided for general reference and language-learning purposes. While the Developer works hard on accuracy, dictionary content is provided "as is": no guarantee is made that any definition, translation, or inflection is complete, current, or error-free, and the App should not be relied upon where a mistranslation could cause harm (legal, medical, or official contexts).
The App's software, design, branding, and original content are owned by the Developer and protected by applicable intellectual-property laws. You may not copy, modify, reverse engineer, decompile, or create derivative works of the App, or extract or redistribute its database, except to the extent such restriction is prohibited by applicable law or permitted by the license terms of the underlying open content. In the event of any third-party claim that the App infringes intellectual-property rights, the Developer, not Apple or Google, is solely responsible for the investigation, defense, settlement, and discharge of such claim.
The App requires no account and works offline. Anonymous crash and performance diagnostics are collected as described in the Privacy Policy, which forms part of these Terms.
The Developer is solely responsible for providing any maintenance and support for the App. Neither Apple nor Google has any obligation whatsoever to furnish any maintenance or support services for the App. For support, email support@govoridictionaries.com.
The App is provided "as is" and "as available", without warranties of any kind, express or implied, to the maximum extent permitted by applicable law. Any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are the Developer's sole responsibility.
For the iOS version only: in the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if any) to you; to the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.
The Developer, not Apple or Google, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of it, including but not limited to: (i) product-liability claims; (ii) any claim that the App fails to conform to an applicable legal or regulatory requirement; and (iii) claims arising under consumer-protection, privacy, or similar legislation.
To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data or profits, arising out of or related to your use of the App. The Developer's total liability for any claim arising from these Terms or the App shall not exceed the amount you paid for the App in the twelve months preceding the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including mandatory consumer-protection rights in your country of residence.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. You must also comply with any applicable third-party terms of agreement when using the App (for example, your wireless carrier's data agreement).
These Terms are effective until terminated. Your rights under these Terms terminate automatically if you fail to comply with them. Upon termination you must cease all use of the App. Sections 4–5 and 8–11 survive termination.
The Developer may update these Terms from time to time. Material changes will be reflected by a new "Last updated" date on this page; continued use of the App after changes take effect constitutes acceptance. The current version is always available at govoridictionaries.com/terms.html.
For the iOS version, Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof. For the Android version, Google and its affiliates are not parties to these Terms and are not responsible for the App.
These Terms are governed by the laws of the Republic of Serbia, without regard to conflict-of-law principles, and without prejudice to any mandatory consumer-protection provisions of the law of your country of habitual residence.
